26 Meta employees sue, alleging AI-driven layoff picks hit workers on medical and parental leave

A lawsuit has been filed by 26 current employees of Meta, alleging that the company utilized artificial intelligence systems to determine layoffs, unfairly impacting workers on medical, parental, or family leave. These employees are part of the 8,000 personnel, roughly 10% of the workforce, that Meta announced would be laid off in May.

The complaint, submitted to a federal court in Oakland, California, claims the use of internal AI tools, including activity-monitoring data and performance rankings, led to biased decisions against those who were on protected leave. The plaintiffs argue that the criteria used to evaluate employee performance inadvertently penalized workers on leave, as they had reduced or no productivity during this time.

Meta, responding to the allegations, stated that the claims lack factual merit and emphasized that workforce decisions were made by human oversight rather than automation. The lawsuit cites several legal violations, including breaches of the Family and Medical Leave Act, the Americans with Disabilities Act, and the Pregnancy Discrimination Act.

A significant portion of the plaintiffs were on parental leave or caregiving leave, with eight identified as women on maternity leave. The legal team asserted that the layoffs disproportionately affected women, who are more likely to take such leaves.
